Clearly this is a political advertisement. Clearly it does not indicate who funded for it.

Will ads like this be allowed within 60 days of an election? And just who will (or thinks they can) stop them?

Good questions. Has the rise of the blogosphere and YouTube already made McCain-Feingold outdated and/or obsolete? Mickey Kaus's Feiler Faster Thesis strikes again.

What makes the Hillary 1984 example particularly thorny and intriguing is the issue of disclosure. Opponents of campaign finance reform - and I'm one of them - think full and immediate disclosure is the best way to deal with money in politics, as opposed to having the government get involved in placing restrictions on free speech. But what about places like YouTube, where partisan operatives can anonymously upload (and then promote) carefully crafted political messages? How in the world do you deal with that? Or do you have to deal with it at all?
